General Terms and Conditions for Facebook Giveaways

1. The organizer of the giveaways is Praxis für Physiotherapie – Anke Seidl & Franz X. Unger.

2. By participating, the Facebook user expressly agrees to these general terms and conditions of participation.

3. Only persons of legal age are eligible to participate. Employees of Praxis für Physiotherapie – Anke Seidl & Franz X. Unger are excluded from participation.

4. The giveaway takes place exclusively on the Facebook page of Praxis für Physiotherapie – Anke Seidl & Franz X. Unger (https://www.facebook.com/seidlunger/?ref=aymt_homepage_panel). All operating, ancillary and consequential costs associated with the prize shall be borne by the winners. The organizer’s right of domicile remains unaffected. The announced prize is described on the Facebook page.

5. In the event of a violation of these terms and conditions, Praxis für Physiotherapie – Anke Seidl & Franz X. Unger reserves the right to exclude the participant concerned from the giveaway. This also applies to persons who use unauthorized means or otherwise attempt to gain an advantage through manipulation. In such cases, Praxis für Physiotherapie – Anke Seidl & Franz X. Unger reserves the right to subsequently revoke and reclaim prizes.

6. The execution of the giveaway will be announced on Facebook. Comments or posts that violate Facebook guidelines, German law and/or copyright, as well as violations of our netiquette, will be removed without prior notice once they become known. The participant will be excluded from the giveaway.

Winners will be selected at random within 2 days after the end of the giveaway period. The winners will be announced on the Facebook page. Each winner must contact the organizer of the giveaway (see section 1) within 48 hours after notification. If the winner does not respond within this period, the prize will be forfeited and a substitute winner may be selected. The prize claim is not transferable to third parties. Prize handover will take place by mutual arrangement.

There is no entitlement to a cash alternative for material or other prizes, nor to any subsequent modification of prizes. The item presented as part of the giveaway does not necessarily have to be identical to the prize won.

7. Praxis für Physiotherapy – Anke Seidl & Franz X. Unger reserves the right to cancel or terminate the giveaway at any time without prior notice and without stating reasons. This applies in particular if:

• Facebook’s terms of use or guidelines are changed during the giveaway and conducting the giveaway is no longer permitted under the valid Facebook regulations.
• Manipulation is detected or the proper execution of the giveaway can no longer be ensured, in particular due to hardware or software failures, program errors, computer viruses, etc.
• Unauthorized interference by third parties occurs, or mechanical, technical or legal problems prevent proper execution of the giveaway.

Upon handing over the prize, Praxis für Physiotherapie – Anke Seidl & Franz X. Unger shall be released from all obligations, unless an earlier release results from these regulations. Praxis für Physiotherapie – Anke Seidl & Franz X. Unger shall not be liable for any personal injury, property damage and/or financial loss arising in connection with this agreement, unless the damage was caused intentionally or through gross negligence (in the case of personal injury, intentionally or negligently) by legal representatives or vicarious agents of Praxis für Physiotherapie – Anke Seidl & Franz X. Unger. Furthermore, Praxis für Physiotherapie – Anke Seidl & Franz X. Unger shall not be liable for unlawful user-generated content within the scope of the giveaway, such as insults, false statements of fact or infringements of intellectual property rights.

If personal data of participants is collected, processed or used within the scope of the giveaway, such data will be collected, processed and used by Praxis für Physiotherapie – Anke Seidl & Franz X. Unger exclusively for the purpose of conducting the giveaway and will be deleted after the giveaway has ended.

9. All information is provided without guarantee. Legal recourse is excluded. The law of the Federal Republic of Germany shall apply exclusively. Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected. These terms and conditions may be changed at any time by Praxis für Physiotherapie – Anke Seidl & Franz X. Unger without separate notification.

10. This promotion is in no way sponsored, endorsed or administered by Facebook. The recipient of the information provided by participants is not Facebook, but Praxis für Physiotherapie – Anke Seidl & Franz X. Unger. Facebook’s liability in connection with this giveaway is excluded.

11. All inquiries and notices regarding the giveaway must be directed to Praxis für Physiotherapie – Anke Seidl & Franz X. Unger and not to Facebook.

12. Legal recourse is excluded for all raffles.
